1. Introduction and Scope

Welcome to ilmaapure.com. These Terms and Conditions (“Terms”) govern your use of our website and the purchase of products and services from us. By accessing this website or placing an order, you agree to be bound by these Terms.

“You” or “Customer” refers to the user of the website or the buyer of goods/services.

2. Products and Services

We specialize in the sale, installation, and maintenance of water purification systems, including but not limited to:

  • Reverse Osmosis (RO) Systems
  • Water Filtration Units
  • Replacement Filters and Parts
  • Installation and Maintenance Services

While we try to display the colours and specifications of our products accurately on the website, the actual product may vary slightly from the images provided.

3. Ordering and Contract Formation

  • 3.1. Placing an Order: Orders can be placed via our website, email, or telephone.
  • 3.2. Acceptance: Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. A contract is formed only when we send you an order confirmation or invoice.
  • 3.3. Availability: All orders are subject to stock availability. If an item is out of stock, we will inform you as soon as possible and offer a refund or an alternative product.

4. Pricing and Payment

  • 4.1. Currency: All prices are quoted in Euro (€).
  • 4.2. VAT: Prices are inclusive of VAT (18%) unless otherwise stated for business-to-business transactions.
  • 4.3. Payment Methods: We accept payment via [Credit Card / Bank Transfer / Revolut / Cash on Delivery]. Payment must be made in full before or upon installation/delivery, as agreed.
  • 4.4. Price Changes: We reserve the right to change prices at any time. This will not affect orders that have already been confirmed.

5. Delivery and Installation

5.1. Delivery Area: We primarily serve the islands of Malta and Gozo.

5.2. Installation Services:

  • Standard installation is included in the price only where explicitly stated.
  • You must ensure that the installation location has accessible plumbing and adequate space for the system.
  • If installation is not possible due to pre-existing plumbing issues (e.g., old pipes, lack of pressure, inaccessible mains), we reserve the right to cancel the installation or charge for additional works required.

5.3. Water Pressure: Some Reverse Osmosis systems require a minimum water pressure to function correctly. It is the customer’s responsibility to ensure their water supply meets these requirements, or to purchase a system with a booster pump.

6. Maintenance and Consumables

  • 6.1. Filter Changes: To maintain water quality and the validity of your warranty, filters must be changed regularly (typically every 6 to 12 months, depending on usage and water quality).
  • 6.2. Service Calls: We offer routine maintenance services. Fees for service calls and replacement filters will be charged at our standard rates unless covered by a specific service agreement.

7. Right of Withdrawal (Returns)

7.1. Cooling-Off Period: In accordance with EU Consumer Rights Regulations, you have the right to withdraw from the contract within 14 days of receiving the goods without giving any reason.

7.2. Conditions for Return:

  • The product must be unused, in its original packaging, and in a resalable condition.
  • Hygiene Exception: Due to health and hygiene reasons, water filters and RO membranes that have been unsealed, installed, or had water passed through them cannot be returned unless faulty.

7.3. Refunds: Upon receiving and inspecting the returned goods, we will refund the payment within 14 days. You are responsible for the direct cost of returning the goods to our address in Żejtun.

8. Warranties and Guarantees

8.1. Legal Guarantee: All hardware sold to consumers comes with a 2-year legal guarantee under Maltese Law, covering protection against latent defects and lack of conformity.

8.2. Exclusions: The warranty does not cover:

  • Consumable parts (e.g., filters, membranes).
  • Damage caused by limescale, sediment buildup, or poor water quality from the mains.
  • Damage resulting from misuse, neglect, or tampering by unauthorized third parties.
  • Water leaks resulting from changes in mains water pressure exceeding the system’s rating (we recommend installing a pressure reducing valve).

9. Liability

  • 9.1. Water Damage: While we take every precaution during installation, we are not liable for water damage caused by existing plumbing failures, sudden spikes in mains water pressure, or leaks that occur after the system has been tampered with by the customer.
  • 9.2. Indirect Loss: To the extent permitted by law, we are not liable for any indirect or consequential loss (e.g., loss of profit) arising from the use of our products.

10.VAT and Taxation

  • VAT at the rate of 18% is applied exclusively to goods delivered within the territory of Malta.
  • For orders delivered to other countries within the European Union, the VAT rate applicable in the country of destination of the shipment will be applied, in accordance with applicable EU regulations on taxation and e-commerce.

11. B2B Supplies (Business to Business)

  • The Company also provides B2B supplies to businesses and companies holding a valid EU intra-community VAT number.
  • To access B2B purchasing conditions, the applicant must register on our website and provide all required company details. B2B purchasing will only be enabled following verification and approval by the Company.
  • The Company reserves the right, at its sole discretion, to accept or reject any request for B2B account approval.

12. Privacy and Data Protection

We respect your privacy. Your personal data (name, address, contact details) is collected solely for the purpose of processing your order, scheduling installation, and sending maintenance reminders. We process data in accordance with the GDPR and the Data Protection Act of Malta.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malta. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the Courts of Malta.
